These Terms of Use govern the photography, floor plan, virtual tour, and related property marketing services provided by Daily As Built LLC ("Daily As Built") to the Client.
These Terms apply to services ordered for short-term rental properties, vacation rentals, direct-booking properties, and properties marketed for sale directly by an owner without representation by a licensed real estate agent.
By placing an order, scheduling services, accepting delivery of, downloading, or using any Deliverables, Client acknowledges that they have read, understood, and agree to these Terms of Use.
Daily As Built provides property marketing services, which may include, but are not limited to:
Services provided are limited to those specifically ordered by Client.
Daily As Built LLC is committed to producing high-quality property marketing media that presents properties professionally while maintaining a fair and accurate representation of their permanent physical characteristics.
Image editing and enhancement techniques are intended to improve visual presentation, consistency, and overall marketing effectiveness. Daily As Built does not use image editing or virtual enhancement services to intentionally create deceptive or misleading representations of a property's permanent features or condition.
Our goal is to help market each property at its best while maintaining professional and ethical standards for prospective buyers, guests, renters, booking-platform users, and other viewers.
Client is responsible for ensuring that the property is clean, organized, and ready for photography at the scheduled appointment time.
Unless otherwise agreed in writing, Daily As Built is not responsible for:
Client should ensure that all amenities intended to be photographed are clean, accessible, operational, and presented in their intended guest-ready or sale-ready condition.
Additional time required because a property is not ready may result in additional charges, incomplete photography, or rescheduling.
Client is responsible for obtaining all permissions necessary for Daily As Built to enter, photograph, scan, and document the property.
Client represents that they are the property owner, an authorized property manager, or otherwise legally authorized to order the services and permit photography of the property.
Client shall ensure that occupants, tenants, guests, contractors, pets, security systems, gates, lockboxes, and access instructions are properly coordinated before the scheduled appointment.
Daily As Built is not responsible for delays or incomplete services resulting from incorrect access instructions, restricted access, locked rooms, unrestrained pets, occupied areas, or inaccessible portions of the property.
Client is responsible for removing or concealing personal, confidential, sensitive, or identifying information before services are performed.
This may include, but is not limited to:
Daily As Built is not responsible for personal or sensitive information that remains visible at the property during photography or scanning.
Photography services may be rescheduled due to weather conditions that, in the professional judgment of Daily As Built, would negatively affect image quality, property presentation, equipment safety, or flight safety.
Drone photography and video are subject to Federal Aviation Administration regulations, weather conditions, temporary flight restrictions, airspace restrictions, property conditions, and the remote pilot's determination that the operation can be completed safely and legally.
Daily As Built does not guarantee that drone services can be performed at every property, even when such services have been ordered.
Daily As Built understands that property schedules can change. Clients are encouraged to provide as much advance notice as possible if an appointment must be canceled or rescheduled.
Appointments canceled or rescheduled with less than 24 hours' notice, or appointments where Daily As Built is unable to perform the requested services because of lack of access, an unprepared property, utility outages, active construction, unrestrained pets, occupants, or other circumstances beyond Daily As Built's control, may be subject to a cancellation, rescheduling, or trip fee.
If additional visits are required because the property was not ready or accessible at the original appointment, additional service and travel charges may apply.
Daily As Built reserves the right to reschedule appointments because of unsafe conditions, severe weather, illness, equipment failure, transportation issues, or other circumstances beyond its reasonable control.
Daily As Built provides services throughout the greater Austin metropolitan area.
Properties located outside Daily As Built's standard service area may be subject to additional travel fees. Applicable travel charges will be disclosed to Client before the appointment is scheduled or confirmed.
Additional travel charges may also apply when multiple visits are requested or become necessary because of property readiness, accessibility, weather, project changes, or additional services requested after the initial appointment.
As part of Daily As Built's standard workflow, Deliverables may include professional image enhancements such as:
Examples of personal property or temporary items include furniture, d�?�©cor, artwork, bedding, vehicles, trash receptacles, garden hoses, seasonal decorations, pool accessories, outdoor furniture, and similar movable objects.
Daily As Built does not intentionally alter, add, remove, repair, or conceal permanent structural features, fixtures, built-in improvements, or material property conditions, including but not limited to walls, doors, windows, roofs, driveways, pools, fences, fireplaces, cabinetry, countertops, appliances, plumbing fixtures, electrical fixtures, landscaping features, views, or other components of the real property.
Virtual staging and other digitally enhanced images are intended to help prospective buyers or guests visualize the potential use and presentation of a space. Digitally added furnishings, d�?�©cor, artwork, bedding, or accessories do not represent the property's actual furnishings or items available to a buyer, renter, or guest unless Client clearly states otherwise.
Daily As Built LLC will not knowingly create or deliver images that materially misrepresent the permanent physical characteristics or condition of a property.
Client is solely responsible for determining whether virtually staged or otherwise enhanced images must be labeled, disclosed, paired with original images, or used in a particular manner under applicable laws, advertising rules, booking-platform policies, sales-platform requirements, or other governing standards.
When Deliverables are used to market a short-term rental, vacation rental, or direct-booking property, Client is solely responsible for the accuracy and legality of all listing information and advertising claims.
This includes, but is not limited to:
Daily As Built does not verify whether a property is lawfully permitted, licensed, insured, zoned, approved, or otherwise authorized for short-term rental use.
Client is responsible for ensuring that all Deliverables comply with the rules and policies of any platform on which they are used, including Airbnb, Vrbo, Booking.com, direct-booking websites, social media platforms, and other advertising or reservation services.
Daily As Built provides marketing and documentation services only and does not inspect, test, certify, or approve the safety, condition, legality, or operation of the property or its amenities.
Daily As Built does not determine or certify compliance relating to:
Client remains solely responsible for property safety, maintenance, inspections, repairs, permits, regulatory compliance, and the accuracy of all safety-related statements made to buyers, renters, guests, or the public.
When Deliverables are used to market a property offered for sale directly by its owner, Daily As Built provides media and marketing services only.
Daily As Built is not acting as a:
Client is solely responsible for the property's listing price, descriptions, square-footage representations, disclosures, advertising claims, showings, negotiations, contracts, inspections, title matters, legal documents, and compliance with all applicable real estate laws.
Daily As Built does not provide legal, brokerage, valuation, inspection, tax, title, or real estate transaction advice.
Photographs, tours, floor plans, and other Deliverables represent the property based on conditions existing at the time services were performed.
Daily As Built is not responsible for later changes to:
Client is responsible for replacing, updating, or discontinuing the use of Deliverables when they no longer fairly represent the property.
Continued use of outdated media is solely at Client's risk.
Marketing Floor Plans are intended to help prospective buyers, renters, and guests understand the general layout and approximate dimensions of a property.
Marketing Floor Plans are created for marketing purposes only and are not architectural drawings, construction documents, certified surveys, or Existing Conditions documentation.
Dimensions, room sizes, square footage, bed placements, furniture layouts, and other information are approximate and should not be relied upon for engineering, permitting, remodeling, construction, fabrication, furniture procurement, accessibility determinations, occupancy calculations, or other technical purposes.
Buyers, renters, guests, property owners, and their representatives should independently verify all property information important to their decision-making or intended use.
Deliverables are provided electronically through Daily As Built's online delivery platform.
Delivery timelines are estimates and may vary based on the services ordered, property size, editing requirements, virtual staging, weather delays, third-party processing, or circumstances beyond Daily As Built's reasonable control.
Client is responsible for reviewing Deliverables promptly after delivery and notifying Daily As Built of any requested corrections within a reasonable period.
Requests for additional photography, substantial editing, restaging, replacement of previously approved enhancements, or revisions beyond the original scope may be subject to additional fees.
Some Deliverables may be hosted, displayed, distributed, or accessed through third-party platforms or service providers.
Daily As Built does not control and is not responsible for the availability, performance, security, formatting, compression, display quality, policy changes, account restrictions, or continued operation of third-party platforms.
Client is responsible for maintaining any accounts, subscriptions, listings, links, or platform access necessary for continued use of the Deliverables.
Payment is due according to the terms agreed upon between Client and Daily As Built.
Daily As Built reserves the right to withhold delivery, restrict access, suspend hosted materials, or revoke permission to use Deliverables until all amounts due have been paid in full.
Additional services, return visits, revisions beyond the original scope, virtual staging changes, travel, and expedited delivery may be billed separately.
All Deliverables remain the intellectual property of Daily As Built LLC.
Client's rights to use the Deliverables are governed by the Digital Deliverables License and Terms of Use, which is incorporated into these Terms of Use by reference.
Unless otherwise agreed in writing, the license applies only to the specific property and marketing purpose for which the Deliverables were created.
Deliverables may not be sold, sublicensed, transferred to an unrelated owner or operator, or reused to market another property without Daily As Built's prior written permission.
To the fullest extent permitted by law, Daily As Built LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or relating to the services provided, the use of the Deliverables, a property transaction, a rental booking, a guest claim, platform action, or reliance upon property information.
Client is solely responsible for the accuracy of property descriptions, listing information, rental information, advertising claims, disclosures, amenity representations, occupancy information, safety statements, and compliance with all applicable laws, regulations, platform rules, and contractual requirements.
Daily As Built LLC's total cumulative liability arising out of or relating to the services provided shall not exceed the total amount paid by Client for the specific services giving rise to the claim.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas.
Any legal action arising from these Terms of Use shall be brought exclusively in the state or federal courts located in Travis County, Texas.
By placing an order, scheduling services, accepting delivery of, downloading, or using Deliverables provided by Daily As Built LLC, Client acknowledges that they have read, understood, and agree to these Terms of Use, the Daily As Built Disclaimer, and the Digital Deliverables License and Terms of Use.
