These Terms of Use govern the existing conditions documentation, LiDAR scanning, measurement, drafting, modeling, and related services provided by Daily As Built LLC ("Daily As Built") to the Client.
For purposes of these Terms, “Deliverables” may include floor plans, measurements, area summaries, photographs, LiDAR scans, point clouds, iGUIDE® tours, CAD files, Revit models, reflected ceiling plans, roof plans, exterior elevations, interior elevations, electrical plans, reports, visualizations, and other documentation specifically identified in the order, proposal, or scope of work.
By placing an order, approving a proposal, scheduling services, accepting delivery of, downloading, or using any Deliverables, Client acknowledges that they have read, understood, and agree to these Terms of Use.
Daily As Built provides existing conditions and as-built documentation services, which may include, but are not limited to:
Services and Deliverables are limited to those specifically selected, ordered, or identified in a written proposal or scope of work.
Any service, drawing, model element, measurement, annotation, level of detail, file format, or area not expressly included in the scope is excluded.
The terms “as-built,” “existing conditions,” and similar descriptions refer to documentation prepared from observable and accessible conditions existing at the property on the date services are performed.
These terms do not mean that Daily As Built:
Deliverables are documentation of visible and accessible existing conditions, subject to the limitations stated in these Terms and the applicable scope of work.
Unless expressly stated in a separate written agreement, Daily As Built is not acting as a licensed architect, professional engineer, registered professional land surveyor, code consultant, building inspector, environmental consultant, or other licensed design professional.
Deliverables do not constitute architectural, engineering, surveying, inspection, code-compliance, structural, environmental, or other regulated professional services.
Client is responsible for engaging appropriately licensed professionals whenever professional design, certification, permitting, surveying, engineering, code review, or other regulated services are required.
Client represents that Client is the property owner or is authorized by the property owner or another legally responsible party to order the services and provide Daily As Built with access to the property.
Client is responsible for obtaining all necessary permissions, tenant notices, access authorizations, security clearances, releases, and approvals required for Daily As Built to enter, photograph, scan, measure, and document the property.
Daily As Built is not responsible for claims or delays arising from Client's lack of authority to order the services, provide access, or authorize the creation or use of the Deliverables.
Client is responsible for providing safe, timely, and unobstructed access to every area included in the scope of services.
This may include:
Client shall coordinate keys, lockboxes, access cards, alarm systems, elevators, security personnel, escorts, tenants, occupants, pets, and site-specific access instructions before the scheduled appointment.
Daily As Built is not responsible for omitted or incomplete documentation caused by locked rooms, restricted access, occupied spaces, stored materials, furniture, equipment, unavailable escorts, security restrictions, unsafe conditions, or other access limitations.
Return visits required because an area was inaccessible during the original appointment may be subject to additional service and travel charges.
Client is responsible for ensuring that areas included in the scope are reasonably accessible and ready for documentation at the scheduled appointment time.
Daily As Built is not responsible for moving furniture, opening concealed assemblies, removing finishes, cleaning the property, operating building systems, or providing specialized access equipment unless expressly agreed in writing.
Obstructions may prevent complete capture of walls, openings, fixtures, devices, finishes, or other conditions.
Client is responsible for providing a reasonably safe work environment and notifying Daily As Built before the appointment of known hazards, active construction, restricted areas, hazardous materials, required personal protective equipment, security procedures, or other site-specific conditions.
Daily As Built may decline to enter or document any area that, in its reasonable judgment, is unsafe or requires specialized training, certification, equipment, fall protection, confined-space procedures, hazardous-material protection, or authorization not previously disclosed or provided.
Client remains responsible for all property, workplace, construction, safety, and regulatory requirements.
Deliverables are based on visible, observable, and reasonably accessible conditions at the time services are performed.
Unless specifically included and capable of being observed, Deliverables do not represent concealed conditions, underground utilities, internal system conditions, hazardous materials, obstructed components, inaccessible areas, or changes made after capture.
Daily As Built is not responsible for concealed, latent, inaccessible, or subsequently altered conditions.
Measurements may be obtained through LiDAR scanning, optical imaging, field observation, third-party capture systems, software processing, and drafting or modeling workflows.
Daily As Built follows commercially reasonable practices intended to produce useful and accurate documentation. However, all measurements and modeled conditions are subject to normal field, scanning, equipment, software, interpretation, and drafting tolerances.
Deliverables should not be treated as exact or certified dimensions for construction, fabrication, manufacturing, structural work, custom millwork, equipment procurement, or installation without independent field verification.
Area totals and square-footage information are based on the visible and accessible conditions, measurement methodology, and scope identified for the Project.
Unless a specific standard and calculation service are expressly identified in writing, Daily As Built does not certify compliance with BOMA, ANSI, RECA, appraisal, tax, lease, survey, or other measurement standards.
Client is responsible for determining the measurement standard required for a lease, sale, appraisal, legal filing, financing, tax matter, occupancy calculation, or other contractual or regulated purpose.
Floor plans and other drawings represent the level of detail included in the applicable service and scope of work. Unless expressly included, drawings may omit or simplify minor irregularities, decorative features, hidden construction, furniture, systems, structural framing, site information, and code or accessibility information.
CAD Deliverables may be provided in DWG, DXF, PDF, or another agreed format. They are intended to document the included existing conditions and are not construction documents unless expressly identified as such in a separate written agreement prepared by an appropriately licensed professional.
Client is responsible for reviewing imported files, units, scale, coordinates, layers, references, and software compatibility before use.
Revit and BIM Deliverables are limited to the model elements, file format, level of development, level of detail, and scope expressly identified in writing.
Model elements may be simplified or generalized to satisfy the agreed scope. Client is responsible for validating the model before incorporating it into design, coordination, estimating, permitting, construction, or facility-management workflows.
This section applies only when these services are specifically ordered.
Reflected Ceiling Plans may show visible ceiling configurations, bulkheads, ceiling heights, lighting, diffusers, and other readily observable elements included in the scope.
Electrical Plans may show visible outlets, switches, devices, and other observable electrical components. Daily As Built does not trace circuits, open equipment, test devices, identify concealed wiring, verify electrical capacity, or provide electrical engineering.
Interior and Exterior Elevations may show visible surfaces, openings, fixtures, cabinetry, equipment, and other elements included in the scope.
Roof Plans are based on conditions observable from safe and authorized capture locations. Daily As Built is not performing a roof inspection and does not certify roof condition, drainage, structural capacity, waterproofing, remaining service life, or code compliance.
Daily As Built may rely on information, documents, instructions, room names, addresses, prior plans, property records, scope descriptions, or other materials supplied by Client or third parties.
Daily As Built is not responsible for errors, omissions, inconsistencies, or delays caused by inaccurate, incomplete, outdated, or misleading information supplied by others.
Client and all downstream users must independently verify dimensions and existing conditions before permitting, demolition, fabrication, procurement, construction, installation, structural modification, or any activity that depends upon dimensional accuracy.
Daily As Built is not responsible for costs, delays, rework, change orders, material purchases, fabrication errors, or construction decisions made without appropriate field verification.
Deliverables represent conditions observed on the date services were performed. Client is responsible for determining whether Deliverables remain current and suitable for the intended use. Continued reliance on outdated Deliverables is solely at Client's risk.
Delivery timelines are estimates and may vary based on property size, complexity, access, services ordered, required file formats, drafting or modeling requirements, revision requests, third-party processing, and circumstances beyond Daily As Built's reasonable control.
Delivery dates are not guaranteed unless expressly stated in a written agreement.
Client is responsible for reviewing Deliverables promptly after delivery and notifying Daily As Built of suspected errors, omissions, or requested corrections within a reasonable period.
Requests involving additional areas, detail, changed instructions, new formats, redesign, later property changes, additional site visits, or work outside the original scope may be treated as additional services and billed separately.
Changes requested after ordering, scheduling, capture, drafting, or modeling may affect fees and delivery schedules. Daily As Built may require written approval of additional fees before performing work outside the original scope.
Appointments canceled or rescheduled with less than 24 hours' notice, or appointments where services cannot be completed because of lack of access, unavailable escorts, unsafe conditions, an unprepared property, utility outages, active construction, tenant restrictions, or other circumstances beyond Daily As Built's control, may be subject to a cancellation, rescheduling, or trip fee.
Projects outside Daily As Built's standard service area may be subject to additional travel, lodging, parking, toll, airfare, rental vehicle, or related expenses. Additional travel charges may apply when multiple visits are requested or become necessary.
Payment is due according to the terms stated in the order, proposal, invoice, or other agreement between Client and Daily As Built.
Daily As Built may require a deposit before scheduling or beginning work and may withhold scheduling, site capture, drafting, modeling, delivery, file access, revisions, or additional services until required payments have been received.
The license to use the Deliverables does not become effective until all amounts due for the applicable Project have been paid in full.
All Deliverables remain the intellectual property of Daily As Built LLC.
Client's rights to use the Deliverables are governed by the Digital Deliverables License and Terms of Use, which is incorporated into these Terms of Use by reference.
Deliverables are prepared for Client for the specific Project and scope identified in the order or proposal. No third party is entitled to rely upon the Deliverables as certified, professionally sealed, or independently verified documentation.
Architects, engineers, contractors, fabricators, consultants, and other downstream users remain responsible for reviewing, verifying, and adapting the Deliverables for their own professional services and intended uses.
Client and authorized project participants may modify Deliverables as reasonably necessary for the specific Project, subject to the Digital Deliverables License and Terms of Use.
Daily As Built is not responsible for changes made by others, format conversions, compatibility errors, design decisions based on modified files, derivative construction documents, or use of outdated versions.
Daily As Built does not guarantee compatibility with every software version, operating system, template, plug-in, device, server, cloud platform, or Client workflow.
Daily As Built does not guarantee permanent storage or archival of Deliverables. Client is responsible for downloading, reviewing, and maintaining backup copies of all files.
Deliverables are provided “AS IS” and subject to the scope, tolerances, assumptions, exclusions, and limitations stated in these Terms and the applicable order or proposal.
To the fullest extent permitted by law, Daily As Built disclaims warranties, express or implied, including warranties of completeness, merchantability, fitness for a particular purpose, and suitability for construction, fabrication, permitting, engineering, architectural, surveying, code-compliance, or legal purposes.
To the fullest extent permitted by law, Daily As Built shall not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or relating to the services, Deliverables, property conditions, use of measurements, construction decisions, project delays, lost data, or third-party reliance.
Daily As Built's total cumulative liability arising out of or relating to the Project shall not exceed the total amount paid by Client for the specific services giving rise to the claim.
If the terms of a written proposal, quotation, Master Service Agreement, service agreement, or other executed contract conflict with these Terms of Use, the terms of the more specific written agreement shall govern for the applicable Project.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.
By placing an order, approving a proposal, scheduling services, accepting delivery of, downloading, distributing, modifying, or using Deliverables provided by Daily As Built LLC, Client acknowledges that they have read, understood, and agree to these Terms of Use, the Daily As Built Disclaimer, and the Digital Deliverables License and Terms of Use.
