These Terms of Use govern the residential photography, drone, virtual staging, floor plan, and related marketing services provided by Daily As Built LLC ("Daily As Built") to the Client.
These Terms apply to services ordered by contractors, builders, remodelers, interior designers, decorators, home stagers, architects, specialty trades, product vendors, and other professionals seeking to document or market residential projects.
By placing an order, approving a proposal, scheduling services, accepting delivery of, downloading, publishing, or using any Deliverables, Client acknowledges that they have read, understood, and agree to these Terms of Use.
Daily As Built provides residential project photography and related marketing services, which may include, but are not limited to:
Services and Deliverables are limited to those specifically selected, ordered, or identified in a written proposal or scope of work.
Daily As Built is committed to producing high-quality residential photography and marketing media that presents completed projects professionally while maintaining a fair and accurate representation of the permanent physical characteristics and visible condition of the property.
Image processing and enhancement techniques are intended to improve visual presentation, consistency, and marketing effectiveness. Daily As Built does not intentionally use image editing or virtual enhancement services to create deceptive or misleading representations of a property's permanent features or condition.
Our goal is to help Client showcase their work while maintaining appropriate professional, ethical, and advertising standards.
Client represents that Client is authorized to order the services and to permit Daily As Built to enter, photograph, scan, and document the property.
Client is responsible for obtaining all permissions, approvals, releases, and authorizations required from the property owner, occupants, tenants, homeowners association, project participants, or other responsible parties.
Client is also responsible for obtaining any permission required to publish, advertise, distribute, submit, or otherwise use photographs of the property or completed project.
Daily As Built is not responsible for claims, disputes, delays, or losses arising from Client's lack of authority to order the services, provide access, or authorize use of the Deliverables.
Client is responsible for ensuring that the property and all areas included in the photography scope are ready at the scheduled appointment time.
Unless otherwise agreed in writing, Daily As Built is not responsible for:
Client should ensure that completed work, furnishings, finishes, lighting, décor, landscaping, and other elements intended to be photographed are clean, installed, accessible, and presented in their intended final condition.
An unprepared property may result in incomplete photography, reduced image quality, additional charges, or rescheduling.
Client is responsible for coordinating access to all areas included in the ordered services.
Client shall coordinate owners, occupants, tenants, pets, contractors, security systems, gates, keys, lockboxes, alarm codes, parking, escorts, and access instructions before the scheduled appointment.
Daily As Built is not responsible for delays, incomplete photography, or omitted areas resulting from restricted access, locked rooms, occupied spaces, active work, unrestrained pets, unavailable representatives, or incorrect access instructions.
Return visits required because an area was not accessible or ready during the original appointment may be subject to additional service and travel charges.
Client is responsible for ensuring that the property owner and occupants are aware that photography will occur and that the resulting images may be used for marketing, portfolio, publication, award-submission, social media, website, or promotional purposes.
Client is responsible for removing or concealing personal, confidential, sensitive, or identifying information before photography begins.
This may include:
Daily As Built is not responsible for personal, confidential, or sensitive information that remains visible at the property during photography.
Client is responsible for providing a reasonably safe working environment and notifying Daily As Built before the appointment of active construction, restricted areas, hazardous materials, required personal protective equipment, unstable surfaces, exposed wiring, incomplete stairs, open excavations, or other site-specific hazards.
Daily As Built may decline to enter or photograph any area that, in its reasonable judgment, is unsafe or requires specialized training, certification, protective equipment, fall protection, or authorization not previously disclosed or provided.
Daily As Built does not assume responsibility for:
Client remains responsible for all property, workplace, construction, and safety requirements.
Exterior photography may be rescheduled when weather conditions would, in Daily As Built's professional judgment, negatively affect image quality, property presentation, equipment safety, or personnel safety.
Drone photography and video are subject to Federal Aviation Administration regulations, airspace restrictions, temporary flight restrictions, weather, wind, visibility, nearby airports or heliports, property conditions, and the remote pilot's determination that the flight can be completed safely and legally.
Daily As Built does not guarantee that drone services can be completed at every property, even when such services have been ordered.
Clients are encouraged to provide as much advance notice as possible when an appointment must be canceled or rescheduled.
Appointments canceled or rescheduled with less than 24 hours' notice, or appointments where services cannot be completed because of lack of access, an unprepared property, active construction, utility outages, unavailable representatives, unsafe conditions, or other circumstances beyond Daily As Built's control, may be subject to a cancellation, rescheduling, or trip fee.
If additional visits are required because the property was not ready or accessible at the original appointment, additional service and travel charges may apply.
Daily As Built reserves the right to reschedule services because of unsafe conditions, severe weather, illness, equipment failure, transportation issues, or other circumstances beyond its reasonable control.
Daily As Built provides services throughout the greater Austin metropolitan area.
Properties located outside Daily As Built's standard service area may be subject to additional travel fees. Applicable travel charges will be disclosed before scheduling or identified in the applicable proposal or order.
Additional travel charges may apply when multiple visits are requested or become necessary because of property readiness, access limitations, weather, scope changes, or additional services.
Daily As Built uses professional High Dynamic Range (HDR) photography techniques to produce images intended to represent the property's overall appearance naturally and consistently under the lighting conditions present at the time of capture.
HDR photography combines multiple exposures to manage bright windows, darker interiors, and mixed lighting conditions. Daily As Built makes commercially reasonable efforts to achieve natural color balance and a faithful visual representation of the photographed space.
However, the appearance of colors, brightness, contrast, textures, materials, finishes, paint, fabrics, wood tones, stone, tile, cabinetry, and other surfaces may vary because of:
Photographs should not be relied upon for precise color matching, paint selection, finish specification, material verification, purchasing decisions, or other color-critical applications.
Photographs are intended to showcase the overall appearance and quality of a project rather than document exact material colors, textures, or finish specifications.
Images reflect the lighting and environmental conditions present at the time of capture and should not be interpreted as a guarantee of how the property will appear under different lighting, weather, seasonal, display, or printing conditions.
As part of Daily As Built's standard workflow, Deliverables may include professional image processing or enhancements such as:
Examples of personal property or temporary items may include furniture, décor, artwork, vehicles, trash receptacles, tools, construction materials, hoses, seasonal decorations, staging accessories, and similar movable objects.
Daily As Built does not intentionally alter, add, remove, repair, or conceal permanent structural features, fixtures, built-in improvements, or material property conditions, including walls, doors, windows, roofs, driveways, pools, fences, fireplaces, cabinetry, countertops, plumbing fixtures, electrical fixtures, landscaping features, or other components of the real property.
Daily As Built will not knowingly create or deliver images that materially misrepresent the permanent physical characteristics or condition of a property.
Virtual staging and digitally added furnishings, décor, artwork, accessories, or other elements are intended to help viewers visualize the potential use or presentation of a space.
Digitally added items do not represent the property's actual furnishings, finishes, inventory, or items included with the property or project unless Client clearly states otherwise.
Client is responsible for determining whether virtually staged or enhanced images must be labeled, disclosed, paired with original images, or used in a particular manner under applicable advertising rules, publication requirements, award-submission standards, platform policies, or other governing requirements.
When before-and-after photography is ordered, Client is responsible for ensuring that Daily As Built has permission to create and use both sets of images.
Client is responsible for accurately describing:
Daily As Built is not responsible for claims that before-and-after comparisons inaccurately attribute work, imply that Client performed work completed by others, or omit project participants.
If Client supplies before images created by another photographer or source, Client represents that Client has permission to provide and use those images.
Photographs may depict furniture, artwork, accessories, finishes, fixtures, products, landscaping, construction work, architectural features, or other elements created, supplied, installed, or owned by multiple parties.
Daily As Built does not determine:
Client is responsible for obtaining appropriate permissions and accurately identifying the contribution of contractors, designers, stagers, architects, artists, vendors, homeowners, and other project participants.
Daily As Built is not responsible for disputes concerning ownership, attribution, authorship, design credit, product credit, staging credit, or intellectual-property rights relating to items appearing in the photographs.
Client is responsible for the accuracy, completeness, and legality of all project information, descriptions, credits, claims, captions, awards, certifications, product information, and other materials supplied to Daily As Built or used with the Deliverables.
This includes claims relating to:
Daily As Built does not independently verify claims supplied by Client.
Client is solely responsible for reviewing and approving all marketing content and ensuring that the Deliverables are used in compliance with applicable laws, professional standards, advertising requirements, publication rules, platform policies, and contractual obligations.
Client may use Deliverables for the specific project and permitted marketing purposes described in the Digital Deliverables License and Terms of Use.
Client is responsible for confirming the image-resolution, file-format, credit, caption, release, exclusivity, and licensing requirements of any magazine, publisher, award program, trade association, website, social media platform, manufacturer, vendor, or other third party.
Submission of Deliverables to a publication, award program, manufacturer, vendor, franchise, licensing organization, or other third party does not grant that third party unrestricted ownership or usage rights.
Any use beyond Client's licensed project use may require separate written permission or licensing from Daily As Built.
Client may not represent that Daily As Built endorses Client, the project, a product, or any claim unless Daily As Built has provided written permission.
Marketing Floor Plans and virtual tours are intended to help viewers understand the general layout and visual appearance of the property.
Marketing Floor Plans are created for marketing and visualization purposes only and are not architectural drawings, construction documents, certified surveys, or comprehensive Existing Conditions documentation.
Dimensions, room sizes, square footage, layouts, labels, and other information are approximate and should not be relied upon for engineering, permitting, remodeling, fabrication, construction, furniture procurement, material estimating, or other technical purposes.
Client and all downstream users should independently verify information important to any technical, purchasing, design, or construction decision.
Deliverables are generally provided electronically through Daily As Built's online delivery platform or another agreed delivery method.
Delivery timelines are estimates and may vary based on property size, services ordered, editing requirements, virtual staging, weather, third-party processing, scope changes, or circumstances beyond Daily As Built's reasonable control.
Client is responsible for reviewing Deliverables promptly and notifying Daily As Built of requested corrections within a reasonable period after delivery.
Daily As Built may correct errors or omissions that are within the agreed scope. Requests for additional photography, new site visits, extensive retouching, alternative edits, restaging, redesign, or work beyond the original scope may be subject to additional fees.
Client's publication, submission, distribution, or use of the Deliverables may be considered acceptance of the Deliverables as provided, except for latent errors that could not reasonably have been identified during review.
Deliverables may be hosted, displayed, distributed, compressed, reformatted, or accessed through third-party platforms or service providers.
Daily As Built does not control and is not responsible for third-party platform availability, performance, security, image compression, color display, formatting, policy changes, account restrictions, search-engine ranking, or continued operation.
Client is responsible for maintaining any accounts, subscriptions, websites, social media profiles, publication accounts, or platform access necessary for continued use of the Deliverables.
Payment is due according to the terms stated in the order, proposal, invoice, or other agreement between Client and Daily As Built.
Daily As Built reserves the right to require a deposit, withhold delivery, restrict file access, suspend hosted materials, or revoke permission to use Deliverables until all amounts due have been paid in full.
Additional services, return visits, extensive revisions, virtual staging changes, expedited delivery, travel, hosting, and third-party charges may be invoiced separately.
All Deliverables remain the intellectual property of Daily As Built LLC.
Client's rights to use the Deliverables are governed by the Digital Deliverables License and Terms of Use, which is incorporated into these Terms of Use by reference.
Unless otherwise agreed in writing, the license applies only to the specific property, project, and marketing purposes for which the Deliverables were created.
Deliverables may not be sold, sublicensed, transferred for unrelated commercial use, or reused to market another property or project without Daily As Built's prior written permission.
Daily As Built does not guarantee any particular level of website traffic, social media engagement, inquiries, leads, sales, awards, publication acceptance, project opportunities, revenue, or other marketing result.
Marketing results depend on numerous factors outside Daily As Built's control, including market conditions, project quality, Client's advertising efforts, audience, publication standards, platform performance, pricing, reputation, and Client's use of the Deliverables.
To the fullest extent permitted by law, Daily As Built shall not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or relating to the services, Deliverables, publication, marketing use, color appearance, project claims, third-party use, or platform performance.
Client is solely responsible for obtaining property permissions, protecting occupant privacy, accurately describing Client's role and project work, providing proper attribution, clearing third-party rights, and ensuring that the Deliverables are used in compliance with applicable laws, contracts, platform rules, and publication requirements.
Daily As Built's total cumulative liability arising out of or relating to the services provided shall not exceed the total amount paid by Client for the specific services giving rise to the claim.
If the terms of a written proposal, quotation, Master Service Agreement, service agreement, or other executed contract conflict with these Terms of Use, the terms of the more specific written agreement shall govern for the applicable Project.
The Daily As Built Disclaimer and Digital Deliverables License and Terms of Use remain applicable except to the extent expressly modified by a written agreement.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas.
Any legal action arising from these Terms of Use shall be brought exclusively in the state or federal courts located in Travis County, Texas.
By placing an order, approving a proposal, scheduling services, accepting delivery of, downloading, publishing, submitting, distributing, or using Deliverables provided by Daily As Built LLC, Client acknowledges that they have read, understood, and agree to these Terms of Use, the Daily As Built Disclaimer, and the Digital Deliverables License and Terms of Use.
